>> breaking news tonight out of oakland. police are confirming that a man was shot near the o dot co coliseum around three o'clock this afternoon. he was taken to the hospital where he died. we are being told it's not related to today's raiders game. and an officer was not involved in the shooting. we'll bring you more details on this shooting as we get them. shots rung out in the middle of the marina this afternoon. leaving one suspect injured and the normally quiet neighborhood rattled. a man accused of robbery and assault - shot by san francisco police in the busy marina district this afternoon. kron four's dan rubin says investigators are still looking for another man who was attacked at an a-t-m. at one o'clock in the afternoon, the marina district is a popular place to get brunch. a man was using this atm at chestnut and pierce. a fight broke out after another man walked up and tried to grab the victim's backpack. according to witnesses, the robbery victim refused to give up his backpack. that's when the suspect used his weapon. a total of seven rounds were fired. the victim was seen jumping into a car. he and a female driver sped off. the suspect ran down toledo street and hid. instead, police say the hispanic male suspect took off running. then, officers say he turned towards them with a gun in

his hand. even then, police say the man didn't give up. that aid continued at s.f. general. at last check, the suspect was in surgery, listed in serious condition. people living nearby are still appauled by what they saw today. in san francisco, dan rubin, kron four news. >> the victim of the initial robbery was later found outside of san francisco. he's now being interviewed by detectives. the criminal investigation continues into how more than a dozen patients were abandoned by their caregivers for several days at a castro valley assisted care facility. those residents.many of them elderly, bedridden or in wheelchairs. are all safe tonight.either with family or at local hospitals after being evacuated saturday. kron4's mureen kelly found that the facility where they were living has a long history of problems. >> reporter: yellow crime scene tape still blocks the driveway at the valley manor community care home.the residential care home was in the process of being shut down by the state.the operators.herminigilda manuel and mary manuel.had their liscense to operate temporarily suspended on thursday by the california department of social services.a spokesperon for that agency says they were monitoring the situation and had been assured that there would be adequate staffing thru the weekend while the residents were helped to find new homes..but in the end at least two janitors and a cook stayed behind to help the 14 elderly patients still living at the facility.but those unpaid staffers finally got overwhelmed and called in the authorities to help. this is complaint which lists the allegations against the two operators.of violations at the castro valley facilty.and two others.one

in oakland which the pair no longer runs and a modesto location which is currently getting new administrators. the allegations include patients not getting proper care.including one incidnet where a client had a seizure after not getting medication.another patient with dementia was alledgely not properly supervised and wandered away.returned by police two days later.the castro valley facilty had fire code violations and back in september was found to have inadaquete staffing.the facility itself.reportely dirty and in disrepair. other staff making false statements to patients and authorities.failing to report patient falls.and multiple employees allowed to work without criminal records clearances. the state is seeking to bar the manuel's from ever operating a residential care facility for the elderly.or even being allowed to work in one. maureen kelly kron4 news. >> a memorial is being held tonight for the teen that was shot and killed by a sheriff's deputy earlier this week. the 13 year old was carrying a replica assault weapon when he was approached by the deputies. the police department later found out that gun wasn't real. as friends and family memorialize the teen, they tell kron 4's alecia reid a young life was taken too soon.

>> reporter: a traditional aztec dance was a part of andy lopez's memorial --- where they also prayed for men, women, elders and children. >> he had goals and dreams that someone took away from him. he had a life to live, and he was only allowed to live 13 years. that's hard. >> reporter: hundreds of people poured through to pay their respectsthere were flowers, rest in peace signs on cars and t-shirts a sea of mourners wore white shirts with photos of andy embedded on them. the teen's father was understandably shaken , but a famly friend tells us the 13 year old and his siblings are good children that were raised well. >> the kids are not bad kids. they're students, beautiful kids. the latin people are very concerned at this moment. >> andy was a very laid back guy, funny, outgoing,

he was just nice to be around >> we never thought this would happen actually. we're all so young and it happened so quick. >> reporter: alecia reid, kron 4 news. a friend of the family tells us they've been getting a lot of requests from people in the community about ways they can donate to andy's funeral. they tell us they will have an account set p by monday. reporting in windsor alecia reid kron 4 news. >> 10 years ago this weekend. a woman under the influence of prescription drugs and alcohol. ran over a 10-year-old boy and his 7-year-old sister. while the two were riding their bike and scooter with their parents in danville. the driver was found guilty of second degree murder. and she is still in prison. today kron four's philippe djegal was in danville as troy and alana pack's parents remembered their two slain children. and, yet a decade has passed. carmen pack says she and her husband bob miss their children troy and alana dearly.

carmen says she also thinks about the woman who ran over her kids. >> i cannot believe i cannot feel for her. >> reporter: in front of more than 100 members of the danville community at sycamore valley elementary. the packs, including their 7-year-old daughter noelle -- born three years after the accident. releasing butterflies and balloons into the sky in honor of troy and alana. >> ironically she shares the same life force. >> reporter: since the crash, bob and carmen pack say they've been busy lobbying against drunk driving through the troy and alana foundation. bob has also worked with state senator mark desaulnier to pass a bill imposing tougher regulations to fight prescription drug abuse. to end the memorial. the packs signed a petition and asked others to do the same. hoping to coolect enough signatures to put a measure on the november 2014 ballot.

which aims to put an end to doctor shopping for prescription drugs. in danville, philippe djegal, kron four news. >> a shooting last night in vallejo left five injured and one dead. police say four car loads of people came to a party in vallejo. one of the cars got a flat tire after hitting a curb. and all the cars pulled over to help. that's when police say a suv with tinted windows approached the group and opened fire. the search is still on for the gunman. authorities still working on a motive for the shooting. >> new details in the deaths of a menlo park couple killed by a drunk driver. the family of balbir singh and his wife kamal will lay them to rest on thursday. the couple were killed and their dog was injured

>> law enforcement agencies from across the world are in the second day of a brutal training exercise right here in the bay area urban shield 2013 is nearing it's completion. it's a regional preparedness exercise hosted by the alameda county sheriff's office. testing how prepared law enforcement agencies and first responders are to face a variety of high-pressure scenarios - such as a school shooting. by utilizing volunteers, the agencies go through training exercises for 48-hours straight.with little to no sleep. the idea is to simulate a real disaster. . to improve upon. urban shield comes to an end monday morning. coming up at eight. new concerns about obamacare. how safe is the healthcare site against cybercrime. we take a look. plus, a brutal mass murder in brooklyn. what would make a man kill his own family in cold blood? and a carnival ride gone bad, may be no accident. investigators are now saying somebody tampered with the ride at the state fair. details, next. a man has been arrested in connection with the murders of his five family members, including four children. it happened late saturday night at a home in brooklyn, new york. three of the children were pronounced dead at the scene, while their mother and five-year-old sibling died at a new york hospital. police described the brutal crime scene. "a mother, two males, two of her sons and two of her daughters that were cut and butchered with a kitchen knife." the children ranged in age from just one-year-old.to nine, while their mother was 37. suspect is the husband's 25- year- old cousin. police say he'd been staying in the home, and has made statements implicating himself in the crime. a wild shootout, chase, and police ambush yesterday in albuquerque left three officers injured and the shooter dead. authorities say the man ambushed police and traded dozens of rounds shooting two officers. he stole a police car driving four miles with police in pursuit towards a busy part of the city.

the man then crashed the car into a gas station. he was killed after shooting the third officer. all three of the officers are expected to survive. new concerns being raised tonight about the security of obamacare's website. .about how much personal information is being stored on the government run website's database. the republican head of the house intelligence committee says the obamacare website could leave users at risk for identity theft and other cybercrimes. congressman mike rogers says the site is vulnerable to cyberattacks and may need a complete overhaul. "they do not have an overarching solid cyber- security plan to prevent the loss of private information. i'm even more concerned today than i was even last week. i know that they've called in another private entity to try to help with the security of it. the problem is they may have to redesign the entire system. the way the system is designed, it is not secure."

we're the biggest economy in the world.and some say, the most powerful. but a new study says we americans fall short on gender equality. zain asher has the story. forget the battle of men versus women. it's the u-s versus the world. and we're not doing too well when it comes to gender equality. the world economic forum looked at where men and women are most equal, and ranked 136 countries. number one? iceland. followed by other nordic countries like finland, norway, and sweden. but if you're looking for the u-s, we're not even in the top ten. nicaragua is ahead of us. so is cuba. the u-s doesn't even make the top twenty. to find us, you have to go all the way down number 23. last year, the u-s was number 22. so we've dropped. the u-s gets high marks for economic opportunity. specifically, there are more women in the work force, and pay is better than in other countries. the u-s also scores high on education for women. but the country falls short when it comes to politics. out of the 535 seats in congress, women hold only 98 of them. and of course, we've never had a female president. compare that to iceland, where women led the country for 20 out of the past 50 years. it's a similar story in india and ireland. and in cuba and nicaragua, there's a greater percentage of women in the legislature. other countries also guarantee paid leave after the birth of a child, and paid time off for workers. while the u-s does not. i'm zain asher in new york. in saudi arabia women calling for gender equality on the roads! but a protest against a ban on women drivers got local police involved. at least 25 women participated in the protest by getting behind the wheel on saturday. authorities say several female drivers were stopped, and made to sign a pledge not to drive again. they were later released to their male guardians. the driving demonstration was a part of a campaign to end the ban on women drivers. after four decades of serving its ketchup.mcdonald's is cutting ties with heinz. the fast food giant cites "recent management changes" as the reason for the switch. mcdonald's says it will transition to other suppliers. the company suggests

three felony accounts of assault with a deadly weapon. as miguel marquez reports, police say he tampered with the ride. >> "we're at the state fair and the ride went upside down and dumped everybody out. there's people that are hurt really, really bad" >> reporter: panicked 9-1-1 calls from the north carolina state fair thursday night. witnesses said the "vortex" ride had stopped and people were getting off, when it restarted. five people were hurt. >> "it just sounded like a bunch of stuff hitting metal." >> reporter: the ride operator 46-year old timothy tutterow is in custody and charged with three felony counts of assault with a deadly weapon. >> "this ride was tampered with after the inspection and critical safety devices were tampered with and compromised." >> reporter: the sheriff's office says tutterow is an independent ride contractor for a company that only had one ride at the fair - the vortex. more arrests in the incident are possible and the investigation is ongoing.

>> "it makes me mad to think that anybody would put people's safety in danger like they have. and i'm not mad i'm furious." >> three people remain in the hospital tutterow's attorney said by what happened. tutterow is due in court on monday. a group of high school students from kentucky escaped a massive fire that broke out on their bus. it happened on friday on a tennessee highway. they were on a field trip to fish the great smoky mountains national park. when one of them noticed smoke coming from the back of the bus. a student describes what happened next. >> "i was sitting right behind the bus driver and there were some drivers, passengers on the side car - in the car - and they were basically just pushing us to slow down. there was one jeep that actually got in feel slowing down dramatically and was just pointing at the back of the bus. and we- the bus driver and i - got off. we looked and there was a lot of smoke back there and we tried to put it out with the fire extinguisher, but once we realized that the fire

rock legend lou reed has died. a publicist for the velvet underground front man says reed died today at the age of 71. details on the cause of death have not been released. reed was a rock pioneer who went from record label

songwriter to a member of the short-lived, but influential rock band velvet underground. in 1970, reed left the velvets for a long solo career turning out classics "walk on the wild side" and "sweet jane." chris brown is in jail today and has been charged with felony assault. police say he was involved in an altercation early this morning in washington dc. tmz reports the singer then reportedly hurled a gay slur at the victim and punched him in the face breaking his nose after he jumped into a picture with fans. the singer is currently on probation for his assault on rihanna in 2009 and could face up to four years of jail time. fleetwood mac co-founder, john mcvie, has been diagnosed with cancer. mcvie is seen here on the far left with the band during a 19-93 news conference. an announcement on fleetwood mac's facebook page says upcoming shows for the band's world tour have been canceled as the 67-year-old mcvie will be undergoing treatment during that time. the band did not give details about mcvie's diagnosis. what a day for bay area football fans. jason is in with your highlights and all the sports coming up.
